Blockbuster Bears Brunt of Facebook Beacon

Well, we knew the day would come when Blockbuster got sued for participating in Facebook’s Beacon advertising program, and that day is here. According to MediaPost, Texas resident Cathryn Elaine Harris is pretty pissed that Blockbuster is sharing her purchase and rental activity with friends on Facebook.

With allegations that Blockbuster’s use of Beacon violates her rights as deemed by the federal Videotape Privacy Protection Act, Harris is looking to bring a class-action lawsuit, demanding $2,500 for each violation of the 1988 statute. The law was passed after a newspaper obtained video rental records of U.S. Supreme Court nominee Robert Bork.

picture-39.pngSo now we’re all wondering: how will this play out? Even though Facebook launched Beacon to much dismay, the company quickly revised its privacy policy to better ensure that users were aware of their participation levels for Beacon, even having the ability to opt out all together.

And Harris isn’t even directing her lawsuit towards Beacon, but towards Blockbuster, based on a law passed two decades ago. Is this Harris’ way of finding a back-door approach to filing a lawsuit?

If this becomes a major lawsuit for Blockbuster, it could eventually determine the way in which individuals are required to provide consent to join a website, for social or commerce purposes. While that’s unlikely to happen, the very fact that a lawsuit has been brought against a Beacon participant could deter future participation from brands hoping to integrate marketing strategies within Facebook.
